Dream Drives – Vehicle Leasing Terms & Conditions

This agreement sets out the terms between Dream Drives and the Vehicle Owner for leasing a privately owned vehicle for commercial rental use under the Dream Drives brand.


1. Vehicle Lease Arrangement

1.1 The Owner agrees to lease their vehicle to Dream Drives for the purpose of short-term hire to customers.

 1.2 Ownership of the vehicle remains with the Owner. Dream Drives operates as the rental agent.

 1.3 A one-time onboarding fee of $395 applies to cover photography, GPS installation, listing setup, and admin costs.


2. Insurance and Liability

2.1 Dream Drives insures the vehicle under a commercial rental policy while under management. Coverage includes:

Third-party liability



Fire and theft



Customer-related damage



2.2 A $2,000 excess applies per incident. If the customer does not pay this, Dream Drives will pursue recovery but is not liable for unrecovered amounts.

 2.3 The Owner must not hold any conflicting insurance during the lease period.

2.4 Accident & Repair Authority: Dream Drives is authorised to manage accidents, insurance claims, and vehicle repairs on behalf of the Owner. For repairs under $1,000, Dream Drives may proceed without prior approval to avoid delays in fleet operation.


3. Insurance Payout and Vehicle Value Acknowledgement

3.1 If the vehicle is stolen or written off, the entire insurance payout received by Dream Drives will be paid to the Owner, which will be considered full and final settlement.

 3.2 The Owner acknowledges:

Valuation is determined solely by the insurer.



Dream Drives is not responsible for any difference between payout and perceived market value.



3.3 The Owner must inform Dream Drives of any significant upgrades or market value changes to ensure appropriate cover.

 3.4 Dream Drives will ensure fair market value is insured, but has no control over final assessments.

3.5 If the Owner wishes to onboard a replacement vehicle after a total loss, the onboarding fee will be waived provided the new vehicle is onboarded within 60 days.


4. GPS Tracking and Monitoring

4.1 The Owner consents to the installation and use of GPS tracking in the vehicle.

 4.2 GPS data may be used for vehicle monitoring, theft recovery, trip tracking, and compliance.

 4.3 Devices will be removed at the end of the agreement upon request.


5. Vehicle Preparation

5.1 The vehicle must meet the following before onboarding:

Clean, tidy, and free of major cosmetic damage



Mechanically sound and roadworthy



Current WOF or COF (with 6-month checks)



Minimum 50% tyre tread



5.2 Vehicles must be supplied with a full tank of fuel at all times.

 5.3 Dream Drives will inspect the vehicle before each rental for safety and presentation.

 5.4 If grooming, detailing, or repairs are needed before listing or after Owner use, costs will be charged to the Owner.

5.5 The Owner warrants that the vehicle is free from active recalls or known mechanical issues at the time of onboarding.


6. Maintenance and Servicing

6.1 Dream Drives will coordinate regular servicing, WOF/COF compliance, and mechanical upkeep.

 6.2 All servicing and maintenance costs are the Owner’s responsibility and will be invoiced or deducted from earnings.

 6.3 A full service history must be provided at onboarding.


7. Bookings by Owner

7.1 The Owner may request to use their vehicle, provided:

At least 7 days’ notice is given



The vehicle is not already booked



7.2 No loss of revenue fees apply for Owner use.

 7.3 Vehicles must be returned in rental-ready condition. Additional grooming or repairs will be billed to the Owner.

7.4 Dream Drives may restrict Owner bookings during peak seasons (e.g. Christmas, public holidays) to prioritise customer demand unless arranged in advance.


8. Owner Earnings

8.1 The Owner will receive 50% of the customer base hire fee (excluding GST).

 8.2 The Owner is not entitled to revenue from:

Add-ons (camping gear, GPS, snow chains, etc.)



Optional insurance upgrades or excess reduction fees



8.3 The Owner will receive 100% of any over-mileage charges paid by the customer.

 8.4 Monthly earnings summaries and itemised statements will be provided.

8.5 The Owner is solely responsible for declaring and paying all taxes (e.g. income tax, GST) on their earnings. Dream Drives does not deduct or report tax on the Owner’s behalf.

8.6 Dynamic Pricing: Dream Drives reserves the right to adjust daily rental rates at its discretion based on seasonality, market conditions, and promotional activity, in order to maximise revenue for both parties.


9. Safe Storage and Security

9.1 Vehicles will be securely stored at our Sydenham facility when not on hire.

 9.2 Overflow storage may be used at our second warehouse in Woolston.

 9.3 Both sites are access-controlled, alarmed, and monitored 24/7.


10. Spare Key and Access

10.1 The Owner must provide a spare key, which will be securely stored.

 10.2 This allows access in case of lost keys, emergencies, or logistics needs.

 10.3 If no spare key is provided, the Owner may be charged for related access or recovery issues.


11. Modifications and Accessories

11.1 Dream Drives may install:

GPS tracking



Branding decals



Other non-permanent accessories



11.2 These will be removed on request at the end of the agreement.

 11.3 No permanent modifications will be made without written permission.


12. Vehicle Relocation and Transfer Drivers

12.1 If a vehicle is dropped off in a location different from its pickup point (e.g. Christchurch to Queenstown), Dream Drives may charge the customer a relocation fee to help cover the cost of returning the vehicle to base.

12.2 Dream Drives may then facilitate the vehicle’s return using a non-commercial transfer arrangement, such as listing it on a transfer website. In such cases, a vetted and fully insured individual may be offered free use of the vehicle for the duration of the return journey. These trips are not considered commercial rentals, and no earnings will be paid to the Owner for this use.

12.3 Dream Drives will act in good faith to minimise return costs, downtime, and ensure the vehicle is returned promptly and safely.


13. Indemnity and Liability

13.1 The Owner indemnifies Dream Drives from any loss, claim, or liability arising from:

Supplying false or incomplete vehicle information



Mechanical defects or failures not disclosed



Failure to disclose recalls or issues impacting safety or roadworthiness



13.2 Dream Drives will act in good faith to protect the vehicle and its value but accepts no liability beyond what is stated in this agreement.


14. Subcontractors and External Services

14.1 Dream Drives may engage third parties or subcontractors for grooming, maintenance, vehicle transport, or administrative services as required.


15. Force Majeure

15.1 Dream Drives shall not be liable for any delay, interruption, or failure to perform its obligations under this agreement due to causes beyond its reasonable control, including but not limited to natural disasters, extreme weather, pandemics, government restrictions, or disruptions to supply chains.


16. Electronic Execution

16.1 This agreement may be executed electronically and shall be considered legally binding as if signed in physical form.


17. General Provisions

17.1 The Owner confirms the vehicle is either unencumbered or that finance has been disclosed and consent obtained.

 17.2 Dream Drives reserves the right to decline, remove, or refuse re-listing of a vehicle at any time.

 17.3 These terms may be updated with 30 days' written notice. Ongoing participation indicates acceptance of updated terms.
